Managing agents, resident managers, and/or owners must submit Section 8 Special Claims within 180 days after the date the unit becomes rent ready. When calculating the daily contract rent, divide the contract rent by the actual number of days in the move out month. Special claims will be accepted only one time per tenant per unit. If the claim has been returned for lack of documentation, it may be submitted only ONE more time.
Please separate different claim types (i.e., damage, unpaid rent, vacancy) and submit them on HUD Form 52670-A part 2. Submit only one type of claim per form.
Appeal Process
If you receive a claim that has been reduced or denied, you have the right to appeal the decision in accordance with the HUD Handbook 4350.3 REV-1, 9-14 A3. To ensure that your appeal is processed quickly, please follow the guidelines below:
- Submit a new form HUD 52670-A, Part 2 (dated 03/2003)
- Submit a new form HUD 52671-C (dated 09/2002) for a vacancy claim appeal
- Submit a new form HUD 52671-A (dated 10/2002) for an unpaid rent or damage claim appeal
- Attach a letter requesting an appeal and include a brief explanation as to why the claim should be paid
- Attach any new or additional supporting documentation
- An appealed claim must be submitted to OHCS within 30 days from receipt of the reduced or denied claim
